Initial Contact & Scheduling:
To begin the mediation process, complete the contact form and include the following details:
- Names and contact information
- A brief description of the issue
- Whether the other party is aware of the request to mediate
- Times you are available for a brief phone call
After the initial call, an intake consultation will be scheduled to determine if mediation is the right approach.
Intake Consultation
Each party will participate in a 30-minute intake session ($50 per person, payable in advance). During this session, Rozlyn will:
- Explain the mediation process, including confidentiality and voluntary participation
- Discuss the dispute in detail from each party’s perspective.
- Identified key concerns, desired outcomes, and any logistical needs (e.g., in-person vs. virtual mediation).
If mediation is appropriate and both parties agree to proceed, a 2-hour mediation will be scheduled.
Mediation Structure
Mediation occurs in a neutral, confidential setting, allowing a respectful and solution-focused environment. Sessions require a minimum two-hour commitment ($125/hour, which may be split between participants), payable in advance.
Step 1: Opening Statements
- The mediator outlines the process, emphasizing neutrality, confidentiality, and voluntary participation.
- Questions and concerns about the process are addressed.
- Each party shares their perspective without interruption, setting the stage for productive dialogue.
Step 2: Identifying Key issues and interests
- The mediator will guide a discussion to clarify key issues, underlying interests, and areas of concern.
- Each party has an equal opportunity to express their priorities and perspectives, ensuring a shared understanding before exploring solutions.
Step 3: Solution-Seeking Process
- The mediator facilitates open communication to explore resolutions that address the needs of both parties.
- Private caucuses (one-on-one discussions with the mediator) may be used if needed.
Step 4: Agreement & Resolution
- If an agreement is reached, it will be documented and signed for clarity and mutual understanding.
- The agreement may be legally binding or serve as a memorandum of understanding, depending on party preferences.
- Even if no formal agreement is reached, the process helps clarify positions and improve future interactions.
